2. Response to DMCA Notice
Upon receiving a valid DMCA Notice, we will:
- Remove or disable access to the allegedly infringing material.
- Notify the content provider responsible for the material that we have removed or disabled access to it.
- Provide the content provider with an opportunity to respond with a counter-notice.
3. Counter-Notice by Content Provider
If the content provider believes the material removed is not infringing, they may send a counter-notice containing the following information:
- A physical or electronic signature of the content provider.
- Identification of the material that was removed or disabled and the location where it appeared before removal.
- A statement under penalty of perjury that the content provider has a good-faith belief that the material was removed or disabled as a result of a mistake or misidentification.
- The content provider's name, address, telephone number, and a statement that they consent to the jurisdiction of the federal court in their district, and that they will accept service of process from the person who provided the original DMCA Notice.
Upon receiving a valid counter-notice, we may restore the removed content unless the copyright owner files a court action seeking an injunction against the alleged infringement.
4. Repeat Infringers
Play Game Online reserves the right to terminate or restrict access to our website for users who are repeat infringers of intellectual property rights.
5. Misrepresentations
Any person who knowingly misrepresents that material is infringing or that material was mistakenly removed may be liable for damages. We encourage all parties to carefully consider their claims before submitting a DMCA Notice or counter-notice.
